GENERAL TERMS AND CONDITIONS OF SALE
Terms and Conditions of Sale Code LEG-TNC-01-001_v01 - Rev. 06/2026
These General Terms and Conditions of Sale (hereinafter "General Conditions") govern the offer and sale of products via the e-commerce website scarpe-da-ballo.com (hereinafter "Site") by the company NICOLE DI STAMBAZZI ISABELLA (hereinafter "Nicole Rimini" or "Seller"), with registered office in Via F. Filzi n. 6, 47814 Bellaria-Igea Marina (RN), Italy, VAT no. 04526820404, Tax Code STMSLL62L55H294V, registered with the Romagna Business Register under no. REA RN-419025.
The user navigating the Site and making a purchase acts in the capacity of a Consumer (a natural person acting for purposes outside their trade, business, craft, or profession, pursuant to Legislative Decree 206/2005 - Consumer Code).
Submitting a purchase order implies full and unreserved acceptance of these General Conditions by the Customer.
1. SUBJECT OF THE CONTRACT AND TYPE OF PRODUCTS
The subject of the contract is the remote sale of footwear and related accessories produced or marketed by Nicole Rimini. On the Site, there are two categories of products:
Standard Products / Ready to ship: Footwear mass-produced according to the standard size, color, and material variants offered directly in the catalog.
Customized or "Made-to-Measure" Products: Footwear handmade and crafted upon specific request by the Customer, by structurally or aesthetically modifying standard parameters (e.g., choosing specific combinations of leathers, heels, soles, or anatomical measurements provided by the Customer via the Globo Product Options application).
2. PRICES, VAT, CUSTOMS DUTIES, AND EXTRAORDINARY VARIATIONS
All product prices published on the Site are in Euros (€) and include VAT at the rate in force in Italy. Shipping costs are not included in the purchase price but are indicated and calculated separately during checkout before the order is submitted.
Application of VAT and Customs Duties: For the purpose of calculating Value Added Tax (VAT), the physical destination address of the products is the sole reference point, regardless of the customer's billing address.
Shipments within the European Union: If the products are destined for an EU country, VAT will be applied according to current regulations.
Extra-EU Shipments: Should the Seller authorize shipments to countries outside the European Union, the transaction will be VAT-exempt pursuant to Art. 8 of Presidential Decree 633/72. In this case, any customs clearance costs, customs duties, or import taxes provided for by the laws of the destination country remain the sole and exclusive responsibility of the Consumer, who must pay them directly upon delivery.
Modifications and Extraordinary Variations (Force Majeure Clause): The Seller reserves the right to change the price lists of products and shipping at any time. However, barring exceptional events, standard price changes will not affect orders that have already been confirmed and paid for. In the event of extraordinary, unforeseeable events beyond the Seller's control—such as wars, geopolitical or energy crises, general strikes, trade restrictions, exceptional spikes in fuel/oil costs, or drastic increases in raw material costs by suppliers—that make the execution of the order under the original conditions objectively impossible or excessively burdensome, the Seller reserves the right to:
Adjust to current rates, informing the customer promptly before production or shipment begins.
Cancel the order if it is impossible to guarantee the original quality and economic standards, providing a full and immediate refund of any amount already paid, without the customer being entitled to any request for compensation or indemnity.
The availability of standard products refers to the actual availability at the time of the order. In case of subsequent unavailability (e.g., simultaneous purchases), the Customer will be informed via email and the order will be canceled with a full refund.
3. PURCHASE PROCEDURE AND PROTECTION OF CONSENT
The sales contract is deemed perfected at the moment Nicole Rimini sends the "Order Confirmation" via email.
A) Obligation of Acceptance and Checkbox: Before proceeding to payment, the Customer must declare that they have read and accepted these General Conditions by ticking the mandatory checkbox at checkout.
B) Customized Products and Consent Tracking: In the case of purchasing a Customized or "Made-to-Measure" Product, the Customer must express their awareness of the exclusion of the right of withdrawal by ticking a specific checkbox that is not pre-selected before adding to the cart. The system will digitally record the action by storing the Timestamp (exact date and time) and the device's IP Address as proof of informed consent.
C) Artisanal Manufacturing, Tolerances, and Specificity of Materials: Every shoe of the brand is a handmade product. The customer acknowledges that the use of highly specialized materials for dance shoes entails inherent characteristics of uniqueness which in no way constitute conformity defects, but rather testify to the quality of the workmanship:
Suede, Nappa, and Faux Leather: Natural leathers may show minor variations in grain or porosity, tending to adapt naturally to the shape of the foot with use. Faux leather and high-quality synthetic materials offer a more rigid and consistent structure, maintaining their shape over time.
The Glitter Family (Fine, Medium, and Coarse): Glitter finishes vary by particle size (from fine, satin-finish glitter to medium, up to coarse and textured high-reflection glitter). All glitter materials may physiologically shed some surface micro-particles during initial use and friction, without this affecting the aesthetics or coverage of the shoe.
Rhinestones and Light Applications: Sparkle points and rhinestones are meticulously applied by hand. As they are protruding and delicate decorative elements, they require extreme care; accidental detachment due to impact, friction, or snagging on clothing during dancing is not attributable to a product defect.
Satin, Fabrics, Lycra, and Prints: Fabrics and satins have delicate weaves; Lycra and elastic fabrics offer a different flexibility compared to rigid materials. In printed or patterned materials, the placement of the design varies depending on how the fabric is cut, making each pair unique.
Technical Mesh and Perforated Materials: Mesh materials are selected to ensure maximum breathability and lightness, and require care when putting them on to preserve the integrity of the micro-mesh.
Small asymmetries in stitching, color shades due to different material and/or dye batches, or millimeter tolerances in fit compared to the brand's standard size charts are to be considered exclusive characteristics of handmade work.
D) What are the rules for the use, validity, and refund of Gift Cards? Our Gift Cards are digital purchase credits that can be spent on all 10 collections on the site. They have a validity of 12 months from the date of issue, are not convertible into cash, and cannot be used to purchase other Gift Cards. If the order amount is less than the value of the card, the remaining balance remains available on the code for future purchases. If the order exceeds the value of the card, the difference can be settled using one of the traditional payment methods accepted by the store.
4. PAYMENT METHODS AND RESTRICTIONS
Payment can be made via the following secure systems integrated into the platform:
Shopify Payments: For payments via credit, debit, and prepaid cards (Visa, Mastercard, Maestro, American Express) and digital wallets (Apple Pay, Google Pay, Shop Pay).
PayPal: Including the "Pay in 3 installments" option, where available and according to the provider's requirements.
Satispay.
Bank Transfer: By choosing this method, the transaction does not take place in real-time. The technical lead times for starting artisanal production or for shipping will only begin from the date the amount due is actually credited and cleared in the Seller's current account.
Restrictions on Cash on Delivery (COD): Due to reasons related to the artisanal nature and exclusivity of production, cash on delivery is not permitted for any orders that include Customized or "Made-to-Measure" footwear. Such orders will only begin processing in the laboratory following the electronic crediting of funds.
5. SHIPMENTS, DELIVERY, AND OBLIGATION TO SIGN WITH RESERVATION
Shipments are carried out via express couriers (InPost, GLS, SDA - Poste Italiane). Until the moment of physical delivery to the customer or a designated third party, the goods travel under the responsibility of the carriers selected by the Seller.
Timing: For standard products in stock, shipment occurs within the technical timeframes indicated at the time of order. For customized and made-to-measure products, production and subsequent shipping times are indicated on the product page or in the order confirmation.
Geographical Limitations: For security and logistical traceability reasons, shipments to P.O. Boxes or anonymous post offices cannot be made. The customer is required to provide a complete physical address.
Customer Obligation upon Receipt (Sign with Reservation): Upon delivery, the Customer is required to check the packaging. If the package appears damaged, crushed, wet, or tampered with, the Customer must collect it by mandatorily stating on the courier's receipt: "I ACCEPT WITH RESERVATION FOR DAMAGED PACKAGING" (specifying the type of damage, e.g., crushed box). In the absence of such formal statement, the Seller will not be liable for damage suffered by the products during transport. Any internal anomaly must be reported to support within 24/48 hours of receipt.
6. DISCLAIMER ON COLORS AND MONITOR VISUAL RENDERING
Images and videos of products are for illustrative purposes. Nicole Rimini is committed to reproducing the characteristics of the materials as faithfully as possible, including through videos in natural light on product pages. However, the final chromatic perception depends on the calibration, brightness, and technology of the screen of the device used by the Customer (smartphone, tablet, or PC). Consequently, a minimal discrepancy in shade does not constitute a conformity defect, but falls within the characteristics of online sales and will be managed solely according to the rules of the Right of Withdrawal for change of mind (with return shipping costs borne by the Customer), where applicable.
7. RETENTION OF TITLE
All ordered products remain the exclusive property of Nicole Rimini until the full amount of the order (including taxes and shipping costs) has been completely and definitively collected by the Seller.
8. RIGHT OF WITHDRAWAL, EXCEPTIONS, AND INTEGRITY OF THE GOODS
Detailed rules regarding the right of withdrawal are contained in the "Withdrawal Policy" accessible in the footer of the Site.
Exclusion of Withdrawal for "Made-to-Measure" items: In accordance with Art. 59, paragraph 1, lett. c) of the Consumer Code, the right of withdrawal, return, or refund is strictly excluded for all customized or made-to-measure products. As a pure commercial courtesy (and without this constituting a permanent obligation), the Seller reserves the right to evaluate, on a case-by-case basis, a single size exchange on the same model. If granted, all logistical costs (return to the laboratory and re-shipment) will remain entirely at the customer's expense.
Integrity Clause (Use and Assessment of Deterioration): The right of withdrawal applies only to goods that have not been used beyond a simple domestic trial. If the returned product shows aesthetic alterations (e.g., deep walking creases on the upper) or olfactory alterations (e.g., lingering perfume, smoke, sweat), the item will be considered severely deteriorated. In such cases, pursuant to Art. 57 of the Consumer Code, the Seller reserves the right to refuse the withdrawal or withhold from the refund a percentage between 80% and 90% of the value of the item, as it is no longer resellable as new.
9. LEGAL WARRANTY OF CONFORMITY
All standard products sold on the Site benefit from a 24-month legal warranty of conformity pursuant to Articles 128 et seq. of the Consumer Code. The Seller is liable for any lack of conformity existing at the time of delivery that manifests itself within two years. The defect must be reported, under penalty of forfeiture, within two months of discovery.
The warranty applies exclusively to pre-existing manufacturing defects and does not cover in any way damage resulting from:
Normal wear and tear of the good and materials over time (e.g., natural wear of the sole).
Improper or negligent use, or use in unsuitable environments (e.g., using dance shoes with technical soles on abrasive external surfaces, asphalt, or cement).
Failure to follow instructions for maintenance and cleaning of the footwear.
Alterations or repairs carried out by third parties without the Seller's consent.
10. ONLINE DISPUTE RESOLUTION (ODR)
Pursuant to Art. 14 of EU Regulation no. 524/2013, the Seller informs the Consumer residing in the European Union that for the resolution of any disputes arising from the online purchase contract, it is possible to access the European Online Dispute Resolution (ODR) platform, managed by the European Commission, available at the following web address: https://ec.europa.eu/consumers/odr/.
11. APPLICABLE LAW AND JURISDICTION
These Terms and Conditions and the sales contract are governed by Italian law. For any civil dispute between the Seller and the Consumer Customer, the mandatory territorial jurisdiction belongs to the court of the place of residence or domicile of the Consumer, if located within the territory of the Italian State.
